    What is CRPS?
Complex Regional Pain Syndrome, or CRPS, is a neuroinflammatory disorder that causes debilitating pain to those who have been diagnosed with it. CRPS is believed by medical professionals to be due to the damage, or a malfunction of the peripheral and central nervous system. The peripheral nervous system is the signal that reaches from the brain to the spinal cord then to the rest of the body, while the central nervous system is made up of the brain and the spinal cord.  CRPS typically comes in two forms

    • Type 1: often occurs after an injury that indirectly inflicts the nerves within the affected limb. Type 1 forms cause 90% of all diagnosed cases of CRPS.
    • Type 2: often referred to as causalgia, this is the least common form of CRPS causes. This occurs when there is direct damage done to a nerve, usually by amputation or another similar type of traumatic damage

Medical knowledge surrounding type 1 forms of CRPS injury is far more substantial than that of type 2 injuries. This may be because of the sure number of type 1 CRPS injuries compared to type 2 CRPS injuries.

Symptoms of CRPS tend to vary in intensity and occurrence from victim to victim. Some of these common symptoms are as follows:

    • Abnormal hair or nail growth
    • A discoloration of the skin
    • Abnormal sensitivity of the skin
    • Inflammation of the area
    • Chronic pain of the affected area
    • An abnormal swelling of the affected area
    • Limited range of motor function
    • General muscle weakness

An early diagnosis of CRPS often leads to a better outcome of the condition in most cases. Although, diagnosis of CRPS is challenging as the symptoms of the disorder arise at different times and under different severity.

The treatment of CRPS is a long, expensive, and not always positive process. For this reason the compensation for, a CRPS prognosis can be quite significant depending on the circumstances. Some of the more common procedures involved in CRPS treatment include:

    • Sympathetic Nerve Blocking: This process includes the injection of an anesthetic next to the spine to block the activity of sympathetic nerves directly and to improve the blood flow to the nerves.
    • Spinal Cord Stimulation: Spinal Cord Stimulation involves the placement of stimulating electrodes into the spine near the spinal cord which provides a tingling sensation to the affected area. This requires for the patient to undergo surgery.
    • Surgical Sympathectomy: This operation involves the destruction of the controversial nerves.
    • Intrathecal Drug Pumps: This involves the use of a pump to supply pain-relieving medications directly into the spinal fluid, to lessen or null the pain the victim experiences.

There are many more surgical and non-surgical procedures that treat CRPS, but out of all of, these treatments, a complete relief of the disorder is never the outcome. While the severity of CRPS can be lessened, a cure remains to be found. An accomplished attorney who has experience in CRPS cases can help you with legal action.

    CRPS Caused by Workplace Injury
Those who have been diagnosed with CRPS because of a workplace injury can either sue or collect workman’s compensation for their damages. The method by which you or a loved one pursue a CRPS caused workplace injury lawsuit depends on how the injury itself was received. For instance, if the injury was caused by a defective product, you may be able to sue the manufacturer of the product. If your CRPS was caused by a toxic substance, you may be able to bring a toxic tort lawsuit against the substance’s manufacturer. If the injury occurred due to the negligence or misconduct of an employer, you may be able to sue the employer directly. Or if the injury occurred and your employer does not have workers’ compensation insurance, you may be able to file a lawsuit against your employer. To determine which course of action is best, call an expert lawyer experienced in CRPS cases for assistance.

Determining the difference between collecting workers compensation for your CRPS work injury and suing the employer for your injury can help in guiding you to understanding the best course of action in reaching a settlement. Let an experienced attorney help.

Can I File Worker’s Compensation for CRPS?
Unlike personal injury cases, there is no fault required for filing for workers’ compensation. Any employee injured on the job is entitled to benefits from workers’ compensation. In workers’ compensation cases you do not have to prove the fault of your employer or your co-workers. Even if the injury was caused by your own negligence, you are still entitled to receive workers’ compensation benefits.

The only trouble is that in a workers’ compensation case you are not entitled to benefits for pain and suffering. In personal injury claims, you are entitled to recover all of the damages suffered, which includes loss of wages, loss of future income, medical expenses, and pain and suffering. Within workers’ compensation benefits, the collector only receives a weekly compensation that covers medical bills and vocational rehabilitation. Often times payments for workers’ compensation will not fully cover recovery and treatment from CRPS. You may require a lawyer to sue your employer for CRPS.

Those who have suffered from CRPS because of an employer can only sue if your employer intentionally hurt you, or your employer has insufficient workers’ compensation or not workers’ compensation insurance at all. This process of proving an employer’s misconduct can be difficult, as they will more than likely have a qualified attorney with expertise in CRPS injury lawsuits to argue their case. It is best to retain expert legal counsel to help you fight for your right to compensation.  If this is the case for you, our team at the top-rated Normandie Law Firm can fit you with a skilled Los Angeles workman’s compensation lawyer that can help you get the benefits that you deserve.
