Special Education Teacher Aide Arrested for Child Sexual Abuse

Special Education Teacher Aide Arrested for Child Sexual Abuse klawyer attorney sue lawsuit

Detectives arrested Gary Spencer Jimenez Jr., 23, under the accusation of sexually abusing a child at Folsom Middle School, according to authorities. Jimenez was arrested on suspicion of kidnapping a child younger than 14 years old, oral copulation by force or fear of bodily injury, and a lewd act on a child younger than 14 years old using force, violence, or duress, according to the police department.

Jimenez, of Folsom, worked as a special education teacher aide with the Folsom Cordova Unified School District. The incident allegedly occurred on August 31, 2023 at the middle school. Allegedly, officials with the school district notified police of an incident reported on campus. The authorities then determined that Jimenez had sexually abused a child.

Detectives stated that Jimenez was employed through a temp agency during the final months of the previous school year; he had also been placed at Oak Chan Elementary School through the temp agency. Detectives believe that Jimenez may have been temporary employed at other school districts, although this has not been confirmed.

Jimenez was arrested on a warrant and booked into the Sacramento County Main Jail with a $1.4 million bail.

The authorities are urging anyone with additional information to come forward as soon as possible.

The Effects of Sexual Abuse in Children

Without a doubt, sexual abuse can have lasting physical, mental, and emotional effects on victims. Children who suffered sexual abuse in schools can experience some of the following:

    • Sexually transmitted infections
    • Unwanted pregnancies (which can pose additional health risks)
    • Injuries to genitals
    • Injuries to reproductive organs
    • Lacerations
    • Fractures
    • Scrapes and bruises
    • Post-traumatic stress
    • Panic
    • Anxiety
    • Depression

Even when the physical effects of sex abuse are gone, the mental and emotional effects can persist. In many cases, victims can suffer with the mental and emotional effects of sexual abuse for the rest of their lives.

If you or your child suffered sex abuse at a school, it is important that you seek legal assistance as soon as possible.

Can I Sue for Child Sex Abuse at a School?

Yes – this is because schools (and the districts) have a duty to keep all students safe. A major part of keeping students safe is ensuring that keep all students safe. A major part of keeping students safe is ensuring that all staff goes through the appropriate hiring process, training, and (once hired) supervision. What does this all mean? All prospective school employees must be subjected to the appropriate background checks. In fact, even after being hired, employees should be subjected to recurring background checks. In addition, it is important that all employees have the necessary training, including training on how to respond if a student is showing signs of abuse. Schools must also have a clear policy on how they handle sexual abuse allegations. They must also be able to effectively supervise staff and student interactions (usually by having cameras in hallways, classrooms, etc.). When a school district fails to ensure that staff does not pose a risk to students, they can be held accountable for any resulting harm.

What about staff hired through temp agencies? Districts work directly with temp agencies expecting that all staff has clear background checks, is trained to work with students, and will not pose a risk to students on campus. However, some temp agencies fail to do their due diligence during the hiring process, so temp employees that should have never been hired end up working at schools. In these cases, the temp agency can be held accountable for resulting harm.

What if the school district previously had issues with the temp agency? If the school district was aware that the temp agency was sending unqualified workers but they continued to work with them, both the school district and the temp agency could be liable and could be sued.
