Nickelodeon Paw Patrol Deluxe Marshall Hat with Flashlight | Product Malfunction Attorney

On April 5, 2018, the Nickelodeon Paw Patrol Deluxe Marshall Hat with Flashlight was recalled. Manufactured by Rayland Ind., imported by Spencer Gifts, and distributed by Spirit Halloween, the product allegedly poses a burn and fire hazard. Approximately 20,000 items are affected by this recall—number 18-137. The recall affects products with SKU number 01292093 and the following date codes: 1703RY01, 1603RY01, and 1503RY01. The defective products were sold from September 2015 to November 2017 at Spirit Halloween stores for approximately $13 each.

The recalled item is sold with a hat and a battery-powered flashlight. According to recall 18-137, the batteries in the flashlight can overheat, which can cause the flashlight to overheat and pose a burn and fire hazard. The recall advises consumers with the defective product in their home to remove the flashlight from the reach of children, remove the batteries, and dispose of the flashlight. The hazard also encourages consumers to contact Spirit Halloween for a full refund after disposing of the flashlight.

Spirit Halloween has received many reports of the flashlight overheating; however, there have been no reports of injuries. Although no injuries have been reported, there is a possibility of unreported injuries. If you or your child were injured by the defective flashlight sold with the Paw Patrol Marshall Hat, you must not follow the recommendations stated in the recall. You should stop the use of the flashlight immediately; however, you should not dispose of the flashlight or contact the company for a refund. What is the Hazard?

According to the recall, the batteries in the defective product can overheat and pose a burn and fire hazard. The burn and fire hazards are severe, especially considering that flashlight is intended to be used by children. Fire hazards can cause more than burn injuries. If a flashlight suddenly overheats and causes a fire, the following injuries might be sustained:

    • First-degree burns
    • Second-degree burns
    • Third-degree burns
    • Fourth-degree burns
    • Fifth, sixth, and seven-degree burns
    • Respiratory injuries, such as breathing oxygen-depleted air, inhaling hot gases, and inhaling smoke.

As you can see, fire hazards can result in a series of injuries. These injuries can undoubtedly leave victims suffering long-term effects, including permanent scarring, nerve damage, loss of mobility, respiratory issues, anxiety, fear, depression, and post-traumatic stress disorder, for example. If you or your children were injured as a result of the Nickelodeon Paw Patrol Deluxe Marshall Hat with Flashlight, you have the right to file a lawsuit and receive compensation for the injuries sustained.

Can You File a Product Liability Lawsuit?

As mentioned above, you can file a product liability lawsuit if you were injured by the defective flashlight sold with the Paw Patrol Marshal Hat. However, you can only file a product liability claim if one of the following three elements exists:

    1. A defect in the product’s design
    2. A defect in the product’s manufacturing
    3. A defect in the product’s labeling

If any of the three elements above exist in the defective product, you have the right to file a lawsuit and receive compensation. All companies have a duty to their consumers. They must subject their products to various safety inspections before making their product available for purchase. All companies should address safety concerns in regards to their products before the product is released to the public. If companies negligently release a defective product to consumers, they might be held liable for any injuries sustained.

    Compensation Available for Your Claim

If you file a product liability lawsuit after you or your child sustained injuries as a result of the defective flashlight or any defective product, you might be eligible to receive compensation. Although the compensation recovered by victims varies depending on the case, many victims are eligible to recover the following forms of compensation:

    • Medical expenses
    • Lost income
    • Pain and suffering
    • Property damage
    • Loss of consortium
    • Funeral and burial costs
    • Punitive damage

As you can see, there are many categories of compensation available for recovery. For more information about the specific compensation you might be eligible to recover, you should contact our law firm as soon as possible. Steps to Ensure a Successful Claim

If you are interested in taking legal action for a defective product, it is essential that you do not follow the advice on the recall. Recall number 18-137, for example, advises consumers to remove the flashlight from children, remove the batteries from the flashlight, dispose of the flashlight, and contact the company for a full refund. Although it seems like the logical thing to do, doing what is recommended by the recall might negatively impact your defective product injury claim. To ensure that you can file a successful product liability claim, you must do the following:

    • Seek medical attention
    • Do not alter the defective product
    • Do not return the defective product
    • Keep all documents and records pertaining to the defective product

If you alter or return the defective product, you are compromising the most important piece of evidence for your claim—altering or returning the product could prevent you from filing a successful claim. If you do not seek medical attention, your injuries might not be connected to the defective product. If you do not keep all documents and records, such as receipts and confirmations, for example, you might have difficulty proving that you purchased the defective product. If you follow the four points above, you should not encounter any difficulties when attempting to file a defective product claim. For more information about the steps listed above, you should contact our attorneys at Normandie Law Firm as soon as possible.
