Skip Hop Recalls Tuo Convertible High Chairs | Defective Product Attorney
Skip Hop has recalled nearly 10,000 Tuo Convertible High Chair units (including 2,000 in Canada) due to a product defect that causes the front legs to detach from the seat. The recall was issued January 9th, 2018. The main product it affects is the Tuo convertible high chair; the high chair can be reduced to a regular chair without a tray and footrest for toddlers. All of the products feature a seat pad that can be flipped and inverted, a removable meal tray, a harness to keep the child secure, and a footrest. For product and style numbers, refer to the CPSC website.
The products were sold by Skip Hop from December 2016 through September 2017. They cost roughly $160. Stores the items were sold at include Babies R Us, Buy Buy Baby, Kohl’s, Target, Dillards, and more, while other items were distributed online via Skiphop’s website and Amazon.
Skip Hop of New York imported the products, but they were manufactured in China.
The company has declared that parents should stop using the high chairs because of the risk of injury from the legs falling off. This can lead to numerous damages to a child. There have been two reports of the legs detaching, resulting in numerous bruises to the affected children. Skip Hop offers a free replacement for the high chair upon contact.
Risk of Injuries to Toddlers
Toddlers are especially injury-prone due to a lack of self-awareness. They can very easily fall off something they climbed on or roll off a bed or couch. They can topple from chairs and bang their heads on furniture and household items from merely running around. The convertible high chairs having a problem with the front legs detaching means the injuries to children can be very severe.
If a toddler is strapped into the seat while the legs detach, he will be trapped when the chair falls over. He may very likely slam his head into the ground; at best, the accident will lead to a few bruises, but the damage can be much more severe – your child could have a traumatic brain injury or even pass away from the blunt trauma.
Toddlers may also suffer other types of head injuries, broken bones, sprains, fractures, bruises, lacerations, and more.
What You May Earn
A successful product liability lawsuit could get you various types of compensation for your injuries. You should be aware, however, that you must have been harmed by the product in some way in order for you to collect damages.
If the high chair hurt your child and your child required medical attention as a result, the medical bills could be covered by the responsible party. This means that any fees related to hospitalization, surgery, medication, and physical therapy could be reimbursed. If there is a need for future medical procedures, those bills could be preemptively covered as well.
You may be able to collect the cost of the product in the event of a malfunction. This counts as property damage, and receipts could show exactly how much you are owed.
Pain and suffering, or emotional stress, can also be handed out. If your toddler developed any sort of psychological issues, fear, anxiety, or PTSD after the accident, you may be able to collect ample compensation for these mental stresses.
Notes on Product Liability
Skip Hop offers a free replacement for the high chairs. In many cases, companies will ask that you return the previous product when they send you the new one. You should not do this – if you are considering filing a product liability claim, the defective chair is the most important piece of evidence that you have. If you try to file a lawsuit and cannot show that the chair was faulty, you will have no ability to prove that the damages came from the item. Make sure you hold onto the product and refuse to surrender it to the company if they ask, and take note to not throw it away.
Also, keep any receipts you have that show you purchased the high chair. If you cannot prove that you bought it, you may have a more difficult time in court. These documents and receipts, whether paper or electronic, will show that you are the lawful owner of the item.
Refrain from tampering with the item or trying to fix it yourself. You could potentially make the problem worse, and if so, the company could claim that you initially caused the damage that made the product malfunction. There is no way of telling what damages occurred when or who is to blame.
Pursue medical treatment as quickly as possible for your child. If there is a gap in between medical treatment and when the accident happened, the injuries you are citing could very easily be attributed to another cause. Swift pursuit of medical assistance helps your case.
