Target Shower Stools Recall Class Action Lawsuit

Target Recalls Shower Stools due to Fall Risk – High Risk of Hip and Leg Injuries to Consumers
On May 26, 2021, Target issued a recall for their Room Essentials Shower Stools. According to the recall, number 21-141, the shower stools can either become unstable or slippery during use, causing the stools to tip over; without a doubt, this poses a significant fall risk to consumers using the product. The recall has affected approximately 58,000 units of the product.

The affected shower stools are white and measure 18 inches tall; they have a three-legged aluminum frame, and the curved seat is plastic. The product has the Room Essentials logo as well as the item number (064-20-1091) printed on the front of its hangtag.

The shower stool was sold exclusively at Target stores nationwide and online from March 2019 to September 2020 for approximately $35 each.

According to the recall, Target has received at least 12 reports of consumers falling off the shower stools. At least 4 of these reports consisted of scratches, bumps, and bruises; at least 1 report consisted of an arm sprain.

The company is asking consumers to return the defective shower stools for a refund.

If you or a member of your family suffered harm due to the defective shower stool from Target, you definitely should not agree to a refund; instead, you should explore the legal options available to you.

Injuries Caused by Defective Target Shower Stools

According to the recall, incidents involving the defective shower stools only resulted in minor injuries, including sprains, scratches, bumps, and bruises. However, many other injuries are possible. Some of the injuries that victims could suffer after falling off shower stools include the following:

    • Head injuries
    • Traumatic brain injuries
    • Neck injuries
    • Back injuries
    • Spinal cord injuries
    • Leg injuries
    • Hip injuries
    • Fractures
    • Sprains and strains
    • Scrapes and bruises
    • Lacerations

What type of consumers use shower stools? This is a very important question. The parties that use shower stools don’t use them because they simply want to but rather because they need to. That is, it is difficult, painful, or downright impossible for them to stand in the shower. They might be elderly or might have a previous injury (like a hip or leg injury) that requires them to use a shower stool for safety or for comfort. Whatever the case, they are typically at a higher risk of injury.

What is the severity of hip injuries and leg injuries? Unfortunately, hip and leg injuries can result in the complete loss of independence and a significant decrease in quality of life. If the affected party is elderly, it could be almost impossible to recover after a hip injury or a leg injury. Even younger victims could struggle to make a recovery, as treatment often involves multiple surgeries and extensive physical therapy.

If you or a member of your family suffered hip and leg related damage, or any other type of injuries, as a result of the shower stools failing, you should explore the legal options available to you.

    What Should You Do?

Based on the details surrounding the incident and the harm that you or a member of your family suffered, you could be eligible to file a lawsuit against Target for their failure to ensure that their products are safe for consumers. How can you prepare to sue? What should you do after an incident with a defective product?

Consider some of the recommendations listed below:

    • Take photos of all physical injuries
    • Take photos of the defective product
    • Take photos of the entire scene of the incident (before any cleanup occurs)
    • Contact Target to report the incident and your injuries (remember to never agree to a free repair, a free replacement, to return the product, or a refund)
    • Speak to witnesses and collect contact information
    • Gather all medical records
    • Gather all records of lost earnings
    • Collect records related to the purchase of the defective product
    • Seek the guidance of a product liability lawyer as soon as possible

Is there a Class Action Lawsuit?

Can I file a class action lawsuit? How can I join or be a part of a class action lawsuit on this case? If the defective product harmed many parties, then it is likely that there is a class action claim in which you could participate. A class action lawyer can help you figure out how to join the specific class action lawsuit. In some cases, there might be mass torts rather than a class action lawsuit – mass torts are single claims against the same company. For more information about how to proceed with your claim, do not hesitate to contact our recall lawyers as soon as possible.
