Understanding the Risk Present in the Defective Product
According to the recall, the product represents a burn and injury risk to consumers. Specifically, the lid of the Dutch oven can explode while it is inside the oven. Without a doubt, consumers could suffer burns varying in severity and degree. In addition, the force of the explosion could cause pieces of the lid to be launched out of the oven, possibly striking consumers; this could lead to facial injuries, lacerations, and other harm, for example. Besides harm to consumers, the defective product could also lead to property damage – specifically damage to the oven in which it was in during the explosion. Regardless of the harm/damages resulting from the defective product, affected consumers should explore the possibility of pursuing a product liability claim.
What is Product Liability?
Product liability determines your right to pursue the company that contributed to the harm that you or a member of your family suffered. Based on the concept of product liability, all companies owe their consumers a duty of care. This duty of care means that companies must test and inspect their products to ensure that they are safe to be released to consumers. Testing and inspecting products allows companies to quickly identify and address the defects present in their products. By failing to do so, companies are breaching their duty of care and putting their consumers at risk of suffering harm. When a consumer is harmed directly due to the defective product and the breach of duty, the company could be liable for all the harm suffered. Because of this, affected consumers could sue – they could file product liability claims. If you would like to learn more about product liability and your right to sue, do not hesitate to seek legal assistance with the experts at our firm as soon as possible.

Is there a Class Action Lawsuit?
Can I file a class action lawsuit? How can I join or be a part of a class action lawsuit on this case? If the defective product harmed many parties, then it is likely that there is a class action claim in which you could participate. A class action lawyer can help you figure out how to join the specific class action lawsuit. In some cases, there might be mass torts rather than a class action lawsuit – mass torts are single claims against the same company. For more information about how to proceed with your claim, do not hesitate to contact our recall lawyers as soon as possible.
File Within the Statute of Limitations
All claims, including product liability claims, are subject to a statute of limitations – which determines the exact length of time that claimants have to sue. If claimants do not file their claims within the time allowed by the statute of limitations, they will lose their right to sue. Because of that, it is essential that you have a thorough understanding of the statute of limitations that applies to your claim.
How much time do you have to sue? In California, claimants interested in pursuing product liability claims normally have to file within a two-year statute of limitations. However, it is very likely for exceptions to apply – exceptions that could toll or pause the deadline and, ultimately, extend the time that you have to sue. To ensure that you have a better understanding of the statute of limitations that applies to your claim, do not hesitate to seek legal assistance with the experts at our firm immediately.
