Generac Generator Recall Class Action Lawsuit

Generac Generator Finger Amputation Lawyer lawsuit attorney sue compensation injury accident incident

On July 29, 2021, Generac issued a recall (number 21-173) for their Generac and DR 6500 Watt and 8000 Watt portable generators. According to the recall, an unlocked handle can potentially pinch consumers’ fingers against the generator frame when it is being moved; this poses a risk of finger amputations as well as crushing injuries. The recall affected over 321,000 units of the product.

The affected generators have gas-powered engines. They have two-wheels and one u-shaped (two-grip, flip-up pin-lock) handle used to help move the generator around. The unit type is located on the frond of the product, while the model numbers and serial numbers can be found printed on a label on the product.

The recalled generators were sold at home improvement stores and hardware stores around the country as well as online. They were available through all the following: W.W. Grainger; True Value; Ravitsky Bros.; Power Equipment Direct; Orgill; Northern Tool & Equipment; Napa Auto Parts; Ace Hardware; Amazon; Blain’s Farm & Fleet; City Electric Supply; Costco; Do it Best; Fastenal; Home Depot; Lowe’s Stores. The defective generators were sold from June 2013 to June 2021 for prices ranging from $790 to $1,480.

The company is urging all consumers affected by the recall to stop using the generators unless they have confirmed that the locking pin is inserted and secured before and after moving the generator; consumers are being urged to contact the company for a free repair kit.

According to the company, there have been at least eight reports of injuries associated with the defective product. Seven of these injuries resulted in finger amputations, and one of these injuries resulting in a crushing finger injury.

Can I Sue? Understanding Your Right to Sue

Although the company claims that there have been only eight reports of injuries associated with their generators, this number is likely not a real representation of the actual injuries that have occurred as a direct result of the defective generators. Considering that over 321,000 units of the product were sold in the U.S. alone, it is possible that there are hundreds if not thousands of incidents of amputations and crushing injuries caused by the defective product.

Were you or a member of your family injured by the defective Generac portable generators? If so, you might have grounds to sue. You could sue Generac for the harm that you suffered due to their defective product based on the concept of product liability. Because the company had a duty of care to ensure that their products were completely safe for their consumers and breached that duty of care by making defective products available for purchase.

Without a doubt, you could pursue a defective product lawsuit against Generac for the injuries resulting from their defective product. However, you might have the option of participating in a class action recall lawsuit against Generac.

How to Join a Class Action Lawsuit

Is there a class action lawsuit against Generac for the product defect that has caused amputations and crushing injuries? As of yet, there is still no active class action lawsuit; however, the recall was just announced very recently, and the legal claims against the company are just starting. Even if there is still no news of a class action lawsuit against the company, you can still start the legal process against the company.

How can you join a class action lawsuit? In most cases, you do not have to do anything in specific to participate in a class action lawsuit. Some class action lawsuits include all affected parties by default and have an option to opt-out. On the contrary, some class action lawsuits require affected parties to opt-in. Regardless of the specific type of class action lawsuit that is being pursued, our lawyers are ready to guide you every step of the way to ensure that you are fairly compensated for the harm that you suffered.

    What Can You Recover?

If you decide to file a lawsuit after being harmed by a defective product, you could definitely be entitled to receive monetary compensation for the harm that you suffered. What can you receive? How much compensation can you receive? Based on the details surrounding the specific harm that you sustained, you could be compensated for some of the following: medical costs; lost earnings; pain and suffering; punitive damages; legal expenses. The type and amount of compensation that you could recover will always be based on the specific details surrounding your claim; therefore, you should seek the expertise of a product liability attorney immediately to learn more about the amount that you could potentially recover.

How much are these cases settling for? What is the average case value? Average value can be determined based on similar injuries. For instance, finger amputation cases are typically valued above the $500,000 mark. This accounts for medical care, financial losses, and pain and suffering, for instance. Crushing finger injuries can be worth more. Specifically, crushing finger injuries can be worth more because of the extensive medical treatment that is required to address the injury, followed by the extensive follow-up care on top of financial losses and pain and suffering. In some instances, these defective product cases involving such serious injuries like finger amputations and crushing injuries can be worth up to $1 million-dollars – and sometimes more.

For more information about what you could be eligible to receive if your product liability lawsuit is successful, do not hesitate to contact the experts at our law firm immediately.
