On September 23, 2020, Caravan Global issued a recall for their Caravan Sports Armed/Padded Arm Bagged Chairs. According to the recall, number 20-189, the chairs’ plastic bracket can bend or fail, causing the fabric seat to rip from the frame; this represents fall and injury risks to consumers. The recall has affected approximately 2,700 units of the product.
The recall specifically includes the Caravan Sports Armed/Padded Arm Bagged Chairs. The chair was available in blue. It measures 24.4” x 23.2” x 36.2”. The chair image as well as the product name is printed on a hang tag that is attached to the chair. The recalled chairs have a tag with “SNY-XZ” printed on it sewn onto the back of the chair.
The defecting chairs were sold exclusively at H-E-B stores in Texas in May 2020 for approximately $20 each. According to the company, there have been at least six reports of the seat fabric separating from the chair frame; however, no injuries have been reported (albeit it is possible that there have been unreported injuries).
The company is urging all affected consumers to stop using the recalled chairs and contact them for instructions on receiving a full refund. Should you follow this recommendation?
If you or a member of your family suffered harm as a direct result of the defective product, you should never consider following the recommendations made by the company. The Risk Associated with the Defective Chairs
As explained above, the plastic brackets on the affected chairs can bend or fail, causing the fabric seat to rip from the chair frame. This can cause unsuspecting consumers to fall and suffer injuries. Although every situation is different, some of the injuries that consumers could suffer could include the following:
- Head injuries
- Traumatic brain injuries
- Neck injuries
- Back injuries
- Spinal cord injuries
- Joint injuries
- Fractures
- Lacerations
- Sprains and strains
- Scrapes and bruises
Regardless of the specific harm that you or a member of your family suffered, you might have grounds to sue. After all, the harm resulting from the defective product could have been completely avoided.
Understanding Product Liability and Your Right to Sue
Your right to sue is based on the concept of product liability. Companies owe their consumers a duty of care – specifically, a duty to ensure that their products are completely safe for their consumers to use. This means that companies must test and inspect their products thoroughly to be able to identify and address any hazards present in their products. Although companies owe this duty of care to consumers, they could breach their duty of care by failing to ensure that their products are safe. The breach of duty can lead to incidents, which can directly lead to harm.
When a defect in labeling, manufacturing, or design, for instance, lead to harm, the company that made the product available to consumers could be liable. This means that affected consumers could sue. More specifically, affected consumers (and their families) could pursue product liability claims. You Could Sue and Recover Compensation
Based on the details surrounding your product liability claim, you could be eligible to recover compensation. What could you receive? How much compensation could you be eligible to recover? Some of the types of compensation that you could be eligible to receive could include the following:
- Medical costs
- Lost earnings
- Pain and suffering
- Loss of consortium
- Funeral and burial expenses
- Punitive damages
- Legal fees
Because the type and amount of compensation that you could be eligible to receive depends strictly on the details surrounding your claim, it is essential that you seek the opinion of a lawyer as soon as possible. Our lawyers are ready to aggressively fight for your right to recover the highest amount of compensation available for your claim. For more information about the type and amount of compensation that you could be eligible to recover upon reaching a successful claim outcome, contact our firm today.
Is there a Class Action Lawsuit?
Can I file a class action lawsuit? How can I join or be a part of a class action lawsuit on this case? If the defective product harmed many parties, then it is likely that there is a class action claim in which you could participate. A class action lawyer can help you figure out how to join the specific class action lawsuit. In some cases, there might be mass torts rather than a class action lawsuit – mass torts are single claims against the same company. For more information about how to proceed with your claim, do not hesitate to contact our recall lawyers as soon as possible.
What Should You Do?
