Polaris has issued a recall for around 600 of their Recreational Off-Road Vehicles, from model years 2021 and 2022. The fuel pump assembly joint on the fuel tank is prone to leaking, which is a fire hazard. So far, there has been one report of a fire due to this problem.
The recall is for models of the RZR Pro XP 4 Premium, Sport, and Ultimate vehicles, which were sold in black, graphite, white, green, and orange. The vehicles have a 4-seat configuration, and the name “Polaris” can be located on the front grille, as well the sides of the vehicle, along with “RZR.” All vehicles were sold through authorized Polaris dealerships from March 2021 through August 2022.
According to Polaris, consumers should stop using the vehicle immediately and contact them to schedule a free replacement of the fuel tank. The manufacturer is also reaching out to vehicle owners directly, so it’s possible that you will hear from them in the near future. Either way, it’s crucial to understand the laws that pertain to defective products, including your right to monetary compensation if you were injured from one of these vehicles. Injuries from a Defective Fuel Tank
A defective fuel tank poses a high risk of fires and explosions, which can lead to various injuries with severe complications. Burns are the most common source of injury, especially those that go beneath the skin and affect the underlying muscles, bones, and nerves. These injuries can result in permanent scarring, disfigurement, and nerve damage, among other things.
In addition, victims may be harmed by falling objects / debris due to the blast from an exploding fuel tank. This is exceptionally dangerous, as the weight and force of a falling or flying object can cause traumatic brain injury, hip fracture, ruptured internal organs, and other severe injuries.
Steps to take after Your Accident
While no two accidents are alike, the steps you must take afterwards are the same for just about every victim. We’ve listed these steps below, as every action counts when you are trying to protect your rights and fight for just compensation from the manufacturer.
- Take photos of the accident scene and any damage to your property, or ask someone else to do it for you if you are seriously injured.
- If at all possible, take photos of your injuries as well. The more evidence you have to document your harm the suffering, the better your chances of obtaining compensation from an injury claim.
- Go to a hospital right away for medical treatment.
- Call the manufacturer to file an accident report, but do not agree to give a recorded statement. Also, turn down any offers to have the vehicle repaired or to receive a refund.
- Gather and organize evidence, such as medical records, your clothing and shoes from the accident, witness statements, and proof of lost wages due to your recovery needs.
- Seek legal advice from an experienced product recall lawyer.
Can I File a Class Action Lawsuit?
Yes, filing a class action is a possibility if you’ve been harmed by an off-road vehicle that was recalled by Polaris. We expect that more victims will contact us in the upcoming weeks and months, and when there are many victims involved, a class action claim or mass tort may be the best way to hold the manufacturer accountable. Still, it’s important to look into all the available legal options and ensure that you are making an informed decision. Fire Injury Lawsuit Average Case Values
As someone who has sustained injuries due to another party’s negligence, you will need to determine which damages you are entitled to from a lawsuit. These include, but are not limited to, cost of medical treatments, lost wages, property damage, pain and suffering, and mental anguish. The combined total of these damages will determine what your lawsuit is worth, which is different for each victim. Thus, we have no way of providing you with an “average” value for these lawsuits. If we had to give a range, an off-road vehicle accident claim may be worth around $250,000 to over $2 million, based on the extent of your injuries.
How Long do I have to File a Claim?
A lawsuit for an injury due to a defective product must be filed within 2 years from the accident date. There are limited circumstances where the statute of limitations may be extended by the court. If, for example, you were a minor at the time of the accident, you would have 2 years from the date of turning 18 to file a lawsuit against the responsible party. In general, extensions beyond the normal 2-year window are extremely rare, so please talk to one of our lawyers right away to initiate an accident injury claim.
