Noah Clothing Issues Recall for Men’s Reverse Fleece Hoodies due to Burn Hazard

noah reverse fleece hoodies recall burn risk hazard flammable product liability lawyer compensation sue
On May 7, 2020, Noah Clothing issued a recall for their Noah Reverse Fleece Hoodies. According to the recall (number 20-119), the Reverse Fleece Hoodie does not meet the federal flammability standards for clothing; therefore, the product poses a risk of burn injuries to unsuspecting consumers. The recall has affected approximately 1,400 products in the U.S.

The recall includes the Noah Clothing-brand 100% cotton brushed reverse fleece sweatshirts; the sweatshirts are long sleeve and hooded. They were sold in a variety of colors, including black, bright red, Kelly green, and light blue. The hoodies were available in men’s sizes XS, S, M, L, XL, and XXL. The hoodies have a drawstring around the neck collar; the hoodies also have contrasting color stitching. “NOAH” is embroidered on the hoodies’ front pocket. In the sewn-in label (at the neck of the hoodie), consumers can find the brand name as well as a red cross. RN 150322 can also be found on the label. The style number affected by the recall is SS4FW19.

The recalls hoodies were sold at Noah Clothing’s New York City store as well as at Dove Street Market’s Los Angeles, California store. The sweaters were also available online via Noahny.com. The hoodies were sold for approximately $150 each from August 2019 through March 2020.

According to the company, no incidents or injuries have been reported because of the defective product. Regardless, the company is urging affected consumers to immediately stop using the recalled hoodies and contact them for a full refund in addition to a $20 gift card (available only after sending the company a photo of the hoodie cut in half). All known purchasers are being directly contacted by the company.

Should you contact the company for a full refund as well as the $20 gift card? If neither you nor a member of your family suffered harm due to the defective hoodies, agreeing to a refund and a gift card is the best option. However, if the defective product contributed to an incident which resulted in harm, you should not even consider agreeing to a refund. Instead, you should explore your legal options.

If you or a member of your family suffered harm associated with the defective product, you should consider the possibility of pursuing a claim. Specifically, you should consider filing a product liability claim. To learn more about your right to file a product liability claim for the harm that you or a member of your family suffered, do not hesitate to seek legal assistance with the experts at our firm at your earliest convenience.

At Normandie Law Firm, our lawyers have many years of experience handling all sorts of claims – including product liability claims. Our product liability lawyers are ready to evaluate your claim and provide you with the guidance necessary to hold the negligent company accountable for all the harm suffered. Federal Flammability Standards

The U.S. Flammable Fabrics Act was designed to prohibit and prevent the introduction/movement of flammable fabrics in commerce. Some fabrics are highly flammable and can be dangerous when worn. This act was passed after hundreds of children suffered major injuries and lost their lives due to flammable clothing. Highly flammable clothing is extremely dangerous. Primarily, the clothing can ignite with the smallest spark. When a fire starts, the first reaction is usually to get as far away as from the fire as possible. However, when a consumer is unknowingly wearing a highly flammable product that suddenly ignites, the consumer cannot get away from the fire. Since the piece of clothing ignites so quickly, there is no time for the affected party for react; therefore, the injuries are likely to be more severe. The act does not completely eradicate incidents involving highly flammable fabrics; however, since companies have to adhere to the regulation, incidents have decreased over the years. Unfortunately, even with the act, some companies fail to ensure that their products meet safety requirements.

Product Liability and Your Right to Sue

Did you or a member of your family suffer harm because of the defective fleece hoodie? If so, you might have grounds to pursue a claim based on the concept of product liability. What is product liability? According to the concept of product liability, all companies owe their consumers a duty of care – specifically, companies have the duty to ensure that their products are completely safe for consumers to use. Companies must adhere to relevant regulations; they must also test and inspect their products to ensure that they are safe to make available to consumers. In some cases, companies can fail to identify and address the hazards present in their products; therefore, they breach their duty of care – and put unsuspecting consumers at risk of suffering harm. When a breached duty of care directly leads to incidents that harm consumers, the companies that breached their duty of care could be found liable for all the harm suffered (based on product liability). If you or a member of your family suffered harm associated with a defective product that was negligently released to consumers, you might have grounds to file a product liability claim. If you would like to learn more about your right to sue based on the concept of product liability, do not hesitate to seek legal assistance with the experts at our firm immediately.

Recovering Monetary Compensation for Harm Suffered

If you or a member of your family suffered harm caused by a defective product, you might have grounds to sue based on product liability. If you reach a successful claim outcome, you might have grounds to recover monetary compensation for all the harm suffered. Could you really be compensated after you or a member of your family suffered harm associated with the defective fleece hoodies recently recalled by Noah Clothing? The type and amount of compensation that you could receive (upon reaching a successful outcome) will always depend on the details surrounding the claim; therefore, it is essential to speak to an experienced attorney for more information on the potential value of your claim.

Although every claim is different, some of the categories available for recover could include some of the following:

    • Lost income, for all wages lost due to the harm suffered (includes future lost wages in some cases)
    • Pain and suffering, for all mental and emotional harm suffered due to the incident/harm
    • Loss of consortium, for the lost ability to have a normal family relationship with the victim

    • Take photos of all physical injuries suffered
    • Take photos of any property damage resulting from the incident
    • Take photos of the defective product
    • Stop using the defective product, put it in a safe place and leave it as-is
    • Seek medical attention immediately (even if injuries do not seem severe)
    • Contact the company (to report the defect as well as the harm suffered)
    • Do not agree to a free replacement or a free repair
    • Do not agree to a refund
    • Do not agree to return the defective product (the defective product will be your primary piece of evidence)
    • Speak to witnesses present at the time of the incident

For more information about the importance of following the steps listed above, contact our firm today.

You Must File Your Claim Promptly

Without a doubt, you might have grounds to sue for the harm that you or a member of your family suffered due to a defective product. To preserve your right to sue, you must file your claim within the appropriate length of time – specifically, within the time allowed by the applicable statute of limitations. What is a statute of limitations? A statute of limitations determines the exact length of time that claimants have to file their claims; if claimants do not file their claims on time, they will lose their right to sue.

How long do you have to file your claim against Noah Clothing or any other negligent company? In California, product liability claims are normally subject to a two-year statute of limitations (meaning that claimants will only have two years to sue). Affected individuals must also be aware that exceptions to the statute of limitations could apply (based on the details surrounding the incident). If any exceptions to the statute of limitations apply, the deadline could be tolled or paused for some time.

Understanding the deadline that applies to claims is one of the most important things that consumers must do. To ensure that you have a thorough understanding of the time that you have to pursue your claim, do not hestiate to contact the experts at our firm at your earliest convenience.
