The Latest Lawsuit Filed against El Monte Union High School District

Since the initial lawsuit filed by former students of Rosemead High, more alumni have spoken out about the grooming, exploitation, and other forms of sexual abuse that went on at the school. The most recent lawsuit, filed on July 24, 2024, included disturbing details about sexual relationship between students and numerous teachers, coaches, and other district employees.

The victims, who are now adults, claim that the incidents happened during 1992 to 2003, when they were teenagers. Their allegations follow a previous lawsuit that was filed 3 months ago by 3 female Rosemead alumni for sexual abuse that took place during 2005 to 2011. Essentially, the women accuse school administrators of allowing a culture of sexual abuse at the school by ignoring predatory behavior by their staff members. The 9 plaintiffs that are part of the recent lawsuit say that school officials ignored their complaints, and even if the allegations were investigated, nothing was ever done about the sexual misconduct by teachers that lasted for over 4 decades,

In a truly tragic account, one victim recalled that she was targeted by several school employees at the same time, and went to her mentor for help. Instead of contacting the police or offering some other form of support, that staff member took advantage of her weakness and confusion in order to rape her.

The abuse of students was so pervasive at Rosemead High that school teachers told the girls to wear revealing clothing, and openly made comments about their bodies or sexual appeal. The plaintiffs claim that the district is responsible for allowing the toxic culture of sexual abuse and assault to go on for so long.

Can You Sue a School District for Sexual Abuse by a Teacher?

Yes, you can sue El Monte Union High School District or any other school system for their failure to protect you from sexual abuse by not taking action when there were accusations against school employees. Alternatively, there were indications of sexual misconduct between staff and students that the school failed to recognize or act on.

Sadly, many victims are unaware of what it means to be sexually abused as a minor. Some of the women who came forward did not understand their rights or that what happened to them was abuse until an article written by Matt Drange for Business Insider was published. He discovered a disturbing pattern of sexual abuse that included at least 20 Rosemead educators, some of whom were still employed by the El Monte Union High School District.

Perhaps you read Matt Drange’s article and kept tabs on the lawsuit that came about as a result. Or, maybe this is the first time you are hearing about a lawsuit filed by victims, just like you, who were sexually abused due to the district’s many years of neglect and misconduct by school administrators. Either way, please know that we are with your every step of the way on your journey to recovery.

How Much can I Receive from a Rosemead High Sexual Abuse Lawsuit?

A lawsuit for the sexual abuse of a minor can result in settlements ranging from $400,000 to $3,000,000. But some cases are worth more due to the number and type of incidents, level of negligence by the school district, and the impact of the abuse on the victim’s life. If you are joining a claim with others, meaning you are filing a class action lawsuit, the amount recovered may exceed $50,000,000. But these awards are shared by all the members in the lawsuit, so the actual payout per victim may be around $1,000,000 or less. How much your lawsuit will settle for is a personal question that must be answered on a case-by-case basis. What is the Deadline to File a Lawsuit?

The simple answer to this question is 22 years from whenever you turn 18 years old, meaning you have up until your 40th birthday to sue for sexual assault while you were a child. For many people, this is ample time to understand the abuse they suffered and start the legal process with help from a school sexual assault attorney.

On the other hand, some people may not recognize the psychological impact of sexual abuse until a much later date. Under California’s discovery rule, victims of childhood sex abuse have 5 years to file a lawsuit starting from when they discover an injury from abused. An injury can be some form of bodily harm, but in most cases, we are talking about mental health issues that the victim has struggled with throughout their lives. But it has taken them many years to realize that their suffering is connected to episodes of sexual abuse while they were under the age of 18.

We have a dedicated team of attorneys who are ready to answer any questions you have about the discovery rule and how you can receive justice if you wish to proceed with a lawsuit.
