On December 28, 202, JoyBuy Marketplace Express issued a recall that involves their Relax 5mm Science Kit Large Hematite Magnets Magnetic Stones Building Blocks. The recall affects over 4,200 units of the product. According to the recall, number 24-071, the recalled magnetic ball sets do not meet federal regulations, as the sets contain one or more magnets that fit into the Consumer Product Safety Commission’s (CPSP’s) small parts cylinder and as the magnets are stronger than allowed. This means that the magnets can potentially be swallowed; any magnets that are ingested can attract each other or other metal objects and potentially become lodged in the digestive system. This can cause perforations, blockage of the intestines, twisting of the intestines, infections, blood poisoning, and death.
The recall involves the 5mm magnetic balls; these are neodymium rare-earth magnets with a strong magnetic flux. They were sold in a set of 216 multi-colored magnetic balls, specifically in a clear, plastic case and a portable tin storage box. The recalled set also includes a storage bag (in black).
The magnetic balls were sold online at Walmart.com from February 2022 through April 2023 for prices ranging between $14 and $15.
Although no injuries/incidents have been reported, the CPSC estimates that up to 2,400 magnet ingestions were treated in emergency departments from 2017 to 2021; the CPSC is aware of at least seven deaths involving the ingestion of magnets (this includes two deaths outside of the U.S.).
The company is urging affected consumers to stop using the recalled magnetic balls, take them away from children, and contact them to receive a pre-paid label to return the product and get a full refund. Although affected consumers should definitely stop using the recalled products, it is important that they do not agree to a refund. Instead, they should explore their legal options as they might have the right to sue.

Possible Injuries Caused by the Recalled Product
As mentioned above, these magnets can be swallowed and lead to a host of problems if ingested. More specifically, the magnets can attract each other or other metal objects, causing them to become lodged in the digestive system. Unfortunately, this can lead to many complications, including perforations in the intestines, blockages in the intestines, twisting of the intestines, severe infections, blood poisoning, and even death. Even if caught early, treatment often involves complicated surgical procedures. No matter the harm that you or a loved one suffered, it is important that you do not settle for just a refund – explore the legal options available to you and fight for your right to fair compensation.
Recommended Steps to Take for Affected Consumers
You might have questions about what to do if you or your family were harmed by the recalled magnetic balls. Consider the following suggestions:

- Never agree to return the product

- Never agree to a refund or store credit
- Speak to any witnesses and gather their contact information

- Seek legal help from an experienced product liability lawyer as soon as possible
How Can I Join a Class Action Lawsuit on this Case?
You might be wondering how to be a part of a class action lawsuit on this case. Firstly, it is important to understand why class action claims and mass tort claims are so common when it comes to defective products. As mentioned above, over 4,200 units of the product are included in the recall; this means that just as many consumers can potentially be affected. Consumers that are harmed in similar ways can come together to hold the negligent product manufacturer accountable for the harm suffered. Is there a class action lawsuit? If there is, becoming a part of it is relatively simple. To participate in an existing class action lawsuit, consumers usually just have to reach out to a class action lawyer and express their desire to participate in a class action. What if there isn’t a class action lawsuit already? Can I file a class action lawsuit and be the first claim? Yes, you can.
