Jetson Electric Bike Recall – Two Deaths Reported

Jetson Electric Bike Recall - Two Deaths Reported sue lawyer lawsuit attorney compensation liability

A recall was announced on March 30, 2023 on Jetson Electric Bike’s Jetson Rogue self-balancing scooters/hoverboards. Around 53,000 units have been recalled by the manufacturer due to a fire hazard that can be caused by the lithium batteries overheating. Tragically, there have been two deaths associated with this product already. Two girls, ages 10 and 15, died on April 1, 2022 from a fire in Hellertown, Pennsylvania. It was concluded by the fire department that the fire started from a 42-volt Jetson Rogue and spread from the room it was into other parts of the house.

The scooters included in the recall were manufactured from 2018 through 2019 and were sold in black, red, pink, blue, and purple with a black platform. The company’s name “Jetson” is printed on one of the sides and on the footpads. Consumers can also look at the charge port, located left of the power button, to make sure there are three ports. Boards with only one pin located on the right side of the power button are not part of the recall.

There have been multiple reports of serious problems with the scooters/hoverboards, including sparking, burning, or melting, which have caused the units to ignite into flames. Consumers are urged by the manufacturer and the U.S. Consumer Product Safety Commission to stop using the scooters immediately. Those who own the 42-volt version of this product can follow the instructions at http://www.ridejetson.com/rogue-recall to request a refund. The site also has instructions on how to safely dispose of the hoverboard’s lithium-ion batteries.

Injuries from a Defective Electric Scooter / Hoverboard

Even before the deaths of the two girls in Hellerton, PA, Jetson had received multiple complaints of these hoverboards smoking, sparking, and catching on fire. Such incidents can cause severe injury to those that are using the scooter, along with people that are nearby. Or, in the worst case-scenario, a fire can spread throughout an entire house and cause injury and death to everyone inside.

Below are examples of injuries and health complications that are caused by fires:

    • First to fourth degree burns
    • Extensive scarring and disfigurement
    • Damage to underlying tissue, like bone and muscle
    • Nerve damage, leading to paralysis and loss of function
    • Smoke inhalation and associated conditions (seizures, losing consciousness, breathing problems)

Can I Sue the Manufacturer for my Injuries?

Yes, you can sue the product maker for your injuries if your accident was caused by an issue that occurred during the manufacturing process. Lack of quality control, poor design, cheap parts, and many other problems can lead to a product being defective and causing injury to innocent victims. However, there may be other parties that are involved when it comes to a dangerous product lawsuit. The company that designed and/or marketed the product, the wholesaler, and other entities may be to blame when there is a significant defect with an electric scooter/hoverboard.

There are many complicated aspects to a product defect injury claim, so it’s in your best interest to contact a product liability lawyer as soon as possible.

What if I Lost my Family Member from this Scooter Catching on Fire?

Sadly, fatality is commonly associated with accidents involving fires, especially among children and the elderly. However, anyone that’s asleep, in the basement or attic, or some other compromised situation at the time of a fire may end up dying, primarily from smoke inhalation. Surviving spouses and family members may have a claim for wrongful death compensation against the manufacturer. This type of lawsuit is meant to provide compensation for the losses that are left behind by the decedent, such as:

    • Funeral expenses
    • Medical bills associated with the decedent’s care
    • Loss of consortium
    • Pain and suffering
    • Loss of expected savings and benefits
    • Legal fees

No amount of money can take away the grief you are left with when you lose someone to a senseless accident. However, compensation is a form of acknowledgement from the defendant that they are responsible for your loved one’s death. In addition, the settlement from these lawsuits will ensure that you can cover all the expenses you are left with through no fault of your own. A wrongful death lawyer at our office can help you understand the legal process and take the necessary actions on your behalf.

What to Do if You’ve had an Accident with this Product

Proving a case of manufacturer liability can be very challenging, so it’s important to take the right steps from the moment you find yourself with an injury from a recalled Jetson Rogue hover scooter. Below are some tips on what you should do, as recommended by our accident injury experts:

    • If you’re able to, take photos or video of all visible injuries, damage to your property, and the defective product.
    • If there are any witnesses that saw what happened, ask for written statements or obtain their contact information.
    • Seek medical attention immediately, as you should never underestimate the severity of injuries from a fire-related accident.
    • Contact the manufacturer to notify them of the accident, but make sure to say no if they ask for a recorded statement. Also, decline any offers to receive a refund or return the product, which can take away your right to file a lawsuit.
    • Save anything that can be used as evidence – medical records, photos of the accident scene, belongings that were damaged in the fire, proof of time you were forced to take off from work, etc.
    • Call a product accident injury lawyer to discuss your rights and legal options.
