How to File an Accident Report with Uber

Uber has quickly become one of the leading rideshare companies. When driving around major cities, it is common to see multiple vehicles with the Uber stickers on car windows and windshields. Like all vehicles, Uber vehicles transporting clients are always at risk of being involved in auto accidents. With the increase of Uber drivers on the road, the rate of Uber auto accidents has also increased.

If you were involved in an Uber accident, you might have questions about the process of reporting the accident. If you have questions or concerns, you should immediately contact the attorneys at Normandie Law Firm. Our Uber accident attorneys have extensive experience handling auto accidents, and with the rising incidents of Uber accident claims, they have developed a specialization for Uber accident claims. Our attorneys can lead you through the process of filing the Uber accident report.

If you were injured in an Uber accident you might have a few of the questions below:

    • How can I file an injury report with Uber?
    • How do I report an injury during a ride in Uber?
    • How can I file an accident report with Uber?

Below, you will find some general information about filing an accident report with Uber. If you have additional questions or concerns, we encourage you to immediately contact our attorneys—they will be available to help you at any time.

Gathering Information for the Accident Report

Before you can file an accident report with Uber, you should do the following:

    1. Get medical assistance. If the accident results in injuries, you must immediately seek medical assistance—your health is top priority. Even if you think your injuries are not severe enough to warrant emergency care, you should seek medical attention. Seeking medical attention also created a record of your injuries—and subsequently associates your injuries with the auto accident.
    2. Take photos of the scene of the accident. You should try to take photos before the vehicles are moved. You must ensure that the vehicle damage is clear in the photos.
    3. Get the information of the other drivers and vehicles involved. You should take down the names and contact information of all drivers involved in the incident. You should also write down or take a picture of the license plate numbers of all vehicles involved. Do not forget
    4. Get witness information. If there were any witnesses to the Uber accident, you should immediately ask them for their contact information.

As you can see, these preliminary steps are designed to help you gather evidence of your accident. If you miss a step, you might have difficulty filing a claim.

    Hit and Run Accident Report

Hit and run accidents can happen when a driver is negligent on the road, and has an accident with another driver, bicyclist or pedestrian. A hit and run accident can be a serious accident. The problem being that when a driver hits another vehicle or person and leaves the scene, it is against the law in all states. If a person’s car is hit by an unnamed or unknown car that leaves the scene, the individual’s collision coverage will usually pay for your repairs to your own vehicle. The uninsured motorist coverage does not kick in here. Uninsured motorist coverage only gets triggered if there is an accident and the driver who hit your car is identified as the driver, and is shown to be uninsured.

In California, the state DMV says that if a person hits another vehicle in the course of driving around, that driver is supposed to try to find the owner if at all possible. There can be situations where the driver of the vehicle is not known, such as if the car is in a large parking garage. In that case, some designation of the information for the driver who hit the car should be left with the damaged vehicle, or at the least leave a note or message with the contact information to be found.

The accident report that will be filled out with law enforcement authorities is a general motor vehicle accident report. It will describe the following information:

    • Type of accident (pedestrian, parked car)
    • Collision or non-collision
    • Object struck (car, pedestrian)
    • Traffic controls (stop sign, traffic signals)
    • Road design (interstate, driveway)
    • Road surface conditions (wet, dry)
    • Weather conditions (clear, foggy)
    • Location of injury (head, neck)
    • Pre-accident action (turning right, slowing for traffic)

If there are any other witnesses to the hit and run accident, then the witness statements should be given to the police or any other law enforcement authorities. This information should definitely be recorded, either at the police station or at the scene of the accident. After the police report is filed, it can be copied and submitted to the insurance company, where it will be added to the other paperwork related to the accident claim.

    Filing the Accident Claim

After you have gathered the information above, you are ready to file the accident claim. You must immediately contact Uber’s emergency hotline at 800-354-8237 or support@uber.com. You can also access a help feature through the Uber app. To report the incident through the app, you will have to access the help section of the menu. In the help menu, you will need to select the more option. You will then have to select the first option, legal, privacy, and other inquiries. You will be taken to another menu, in which you must select report a serious incident involving a driver or vehicle. Under the introductory information, you will find a hyperlink that reads I was in an accident; selecting this hyperlink will take you to the page where you can report the accident.

After you report the accident, Uber will start an internal investigation. If you are a driver, it is likely that Uber will deactivate you as a driver during the investigation process.

After You Report the Accident to Uber

After you contact Uber and file the accident report, you will need to start contacting insurance companies. It is important to note that all Uber drivers are independent contractors; therefore, Uber will not carry liability in the case that their drivers cause the accident. If you were injured in an Uber accident, you must contact the insurance company with which the liable driver has a policy. If the liable driver is uninsured or underinsured, you might be eligible to file a claim under Uber’s one million dollar insurance policy.

Uber’s one million dollar policy covers liability, uninsured drivers, and underinsured drivers—all for $1 million each. However, the policy only applies under specific circumstances. So, when does Uber’s one million dollar policy apply to your Uber accident? If you are a driver, the million dollar policy will only apply if you are logged onto the Uber app. If you are logged onto the app but have not accepted a ride request, you will only be partially covered by the million dollar insurance policy. If you have accepted a ride request and you are either on your way to pick up a passenger or already driving a passenger, you will be fully covered by the million dollar policy. Naturally, if you are not logged onto the app, you will not be covered by the policy.

If you are a passenger in the Uber vehicle, you will be covered under the million dollar policy. If you are an injured third party outside the Uber vehicle, such as a bicyclist, pedestrian, motorcyclist, or other driver, you will only be covered by the million dollar policy if the Uber driver involved was logged onto the app without a passenger or logged onto the app with a passenger—partial or full coverage, respectively.

Before you try to file a claim under Uber’s million dollar insurance policy, you must remember that coverage is contingent on the liable driver’s personal insurance—in other words, Uber’s policy is supplemental. If the liable party is uninsured or underinsured, you will be eligible to file a claim for Uber’s insurance.

Since insurance companies will do everything to ensure that victims do not receive a payout, you might need to contact an Uber accident attorney to guide you towards this process. Our attorneys will help you recover the compensation you deserve.
