Guardian Caps are a product designed to enhance football helmets to essentially better manage the energy of repetitive impacts. The product is flexible and soft and goes over the regular helmet. According to reports, the Guardian Cap reduces the force of impact approximately 10% to 15%. This is based on NFL speeds. This becomes a 20% reduction of impact when two players are wearing the product.

The Guardian Caps are being used during NFL practice. Colleges, high schools, and youth programs with football teams soon followed suit. Players, coaches, and parents (of underage players) are likely to feel at ease because of this supposed extra protection during impact; however, the statistics that back up these products can be misleading, potentially leading to devastating harm.

If you or a loved one suffered a head injury because of the Guardian Caps, you could have grounds to file a product liability lawsuit. For more information about your right to file a lawsuit, contact the experts here at our law firm immediately.

What’s Wrong with the Guardian Caps?

The Guardian Caps are made out of closed cell polyurethane foam. The outside of the product is designed to repel water, and the interior padding of the product will not absorb water; therefore, they are supposed to be safe to hand wash for repeated use. The Guardian Cap can last quite a while depending on the use. For instance, in youth level football, it is expected to have a lifetime of 3 to 4 years. At the high school level, it is expected to have a lifetime of 2 to 3 seasons.

So far, there is no clear defect present in the Guardian Caps. However, even a minor defect can be potentially devastating especially considering that the product is supposed to protect against head injuries resulting from the contact sport. Compressed caps, torn straps, broken snaps, etc. can all make the product unsafe for use. According to the company, this can happen due to normal wear as well as normal use. However, if the product is negligently designed or manufactured (e.g., it’s made with poor quality products, improperly assembled/stitched, etc.), then it can pose a danger to consumers.

Of course, defective Guardian Cups can result in head injuries like concussions and traumatic brain injuries, for instance.

If you or a loved one suffered harm due to a defective Guardian Cap, it is essential that you seek legal assistance as soon as possible.

What to do If You or a Loved One was Injured

If you or a loved one suffered harm associated with the Guardian Cap football caps, it is essential that you seek legal assistance as soon as possible. You could have grounds to file a lawsuit. You might have questions about what you should do. Consider the recommended steps to take listed below:

    • Seek medical attention for all injuries
    • Take photos of any visible injuries
    • Take photos of the defective product
    • Speak to witnesses and collect their contact information
    • Gather any video footage that might have captured the incident
    • Collect all medical records
    • Contact the product manufacturer and report the incident
    • Do not agree to return the defective product, to a free repair, or to a refund
    • Seek legal assistance with a recall lawyer as soon as possible

Can I File a Class Action Lawsuit for Injuries due to a Defective Guardian Cap?

Is there a class action lawsuit already? Although there is still no class action claim for this defective product, it is just a matter of time before injury cases start appearing and there is a class action. Mass torts or class action lawsuits occur when there are multiple victims that were harmed in a similar manner. Can I file a class action lawsuit? How can I join or be a part of a class action lawsuit on this case? In general, joining a class action can be as simple as opting in or out; this is when the class action already exists.
