Fatal Crash in Blooming Kills 3, Injures 1
3 siblings were fatally injured while out walking with their mother in Bloomington. The incident occurred around 8:30 p.m. on Sunday, June 24th, while the family was in their neighborhood.
A young man driving a Dodge Challenger lost control while driving the vehicle and wound up striking the family. The siblings were Andrea Jaureguis, 13, Manuel Jaureguis, 17, and Angel Jaureguis, 20; their mother, 49 year old Marie, was injured and transported to the hospital.
The driver of the Challenger, Leonardo Bravo, 19, was not arrested at the scene and officers said that there were no suspicions of drugs or alcohol playing a role in the crash. They did say, however, that speeding could have been a factor, a point that was echoed by residents of the area. The crash happened on Slover Ave, where homeowners say that cars routinely speed at night. Although this is dangerous in and of itself, the specific area in question has a dip in the road that can cause vehicles to lose control, especially if they’re going fast.
Investigators have not yet determined what caused Bravo to lose control.
The Dangers of Car Accidents
Car accidents happen every day, but some are much more serious than others. In such severe crashes as the one in Bloomington, there should be some kind of legal action taken against the responsible entity. It is important to find out who was negligent in his duties and who caused the crash.
Considering that car crashes are usually the product of one person not paying attention, it can be straightforward to determine the negligent party in a crash involving pedestrians walking on the sidewalk. Cars can cause extreme damage to other vehicles and the people within them, but when there is no barrier or protection, the results can be fatal.
It is crucial that you take as many precautions as necessary to stay safe while out. A car crash can happen at any given time, even if you are obeying all laws and paying close attention. A simple act of negligence from a driver can cause a severe collision. In the event of a crash, you should look into filing a lawsuit against the responsible entity.
Legal Information
If you are hurt in a car crash, you can take legal action against the responsible party. You are entitled to financial compensation if the damages were brought on by another driver, and the insurance company representing the driver can cover your bills. There is no different procedure if you are a pedestrian or bicyclist who got hit by a car.
In order to successfully file a lawsuit, you must be able to prove that the driver had a duty of care that he owed to you – which all drivers do; they must not harm anyone else on the road or near it and must drive safely at all times. You must show that the duty of care was breached in some way, whether by breaking the law and driving recklessly or else simply not paying attention. Then, you must prove that the breach of duty was what caused the accident, and that the accident resulted in actual physical harm. If you were not physically injured in a crash, you will not be able to file a personal injury claim for a car accident.
Accident Procedure
Immediately after getting involved in a car accident, you should seek medical assistance. If you require emergency or urgent care, an ambulance can transport you to the hospital. Depending on the severity your injuries, the paramedics may simply treat you at the scene of the accident. Even if you feel as though you were not hurt, you should still be treated – some injuries can sneak up on you and show up after a few days, once the adrenaline has worn off. You can also ask for a copy of the medical report; the bills will be sent to you separately.
You should make sure to acquire the evidence of the accident as well. This means taking pictures of your injuries and the damage to your vehicle. You should ask any eyewitnesses or other passengers to give their testimonies to back up your claim. If the police come, you can request a copy of the police report.
It is necessary that you take down the driver’s information, including his name, driver’s license number, phone number, insurance company, and more. All of this will be gathered and submitted to one of our expert layers to help you get through the legal process and file a claim.
The Process
We will assemble your evidence for you and send it out to the insurance company representing the responsible driver. The insurance agent will review your claim; if he finds it applicable and wants to pay out the settlement we request, you could expect a check within a few weeks. However, this is almost never the case, and insurance agents will instead try to keep every penny their company makes. They may try to throw your case out or offer you such a low sum that it’s insulting.
Our lawyers will negotiate with the insurance agent until a satisfactory offer is made. The agent will refer to your injuries and how severe they were to determine the value of your case; the more damages you suffered and the more profound of an impact they have on you, the higher your offer will be. Our job is to make sure that you get the fairest compensation possible.
You must take care to file your claim within 2 years of the incident, though, as the statute of limitations will run out otherwise However, if you were a minor at the time of the incident or if you were mentally or physically unwell, the deadline would be extended until you turned legal age or returned to normal health.
