A product recall has been issued by
DR Power Equipment on the PRO XL501 Chipper Shredders. The recall, which involves model numbers CS35050BEN and CS35050BENR, is due to a defect with the chipper shredder’s fin scroll. There have been 6 reports so far of the fin scroll failing and causing pieces of metal to fly out from the chipper shredder hopper. As a result, the user may experience deep lacerations and related health complications.
DR Power Equipment is contacting all known consumers directly, but product owners can also call the company to receive a free repair kit. Alternatively, the manufacturer will arrange for a free repair service at a local servicing center if the consumer isn’t comfortable making the repairs on their own.
However, we urge anyone that’s been injured by this product to reach out to our office before they accept anything from the manufacturer. You may have grounds for a defective product lawsuit, which will reimburse you for medical expenses, lost wages, and other financial losses. Complications from a Laceration Injury
Cuts on our skin occur on a fairly regular basis, and many people feel that these injuries are not a big deal. But deep cuts made by flying pieces of metal can cause serious complications, including infections and permanent scars. When metal and debris from soil and wood are involved, there is an increased risk of tetanus – a painful infection that causes muscle contractions, and possibly death, due to its effects on the nerves that regulate your breathing and heart rate.
To prevent such devastating consequences, it’s highly recommended that you go to a hospital if you’ve suffered lacerations due to ejected pieces of metal from this product.
What Steps Do I Need to Take after an Accident?
Even though it’s clear that these chippers have the potential to cause harm, there are steps you must take to establish a direct link between the product and your injuries. The actions listed below should be taken as soon as possible after your accident:
- Take photos of the injuries you’ve sustained if at all possible.
- Ask any witnesses for a statement of what they saw, or get their phone number and/or email so that you can contact them later.
- Seek medical attention to ensure that your wounds are properly sterilized and treated.
- Contact the manufacturer to notify them of your injuries, but turn down any remedies they offer, such as a refund or a scheduled repair service.
- Keep all your medical records, witness statements, proof of lost wages, and other evidence in a safe place.
- Get legal advice from a lawyer that’s experienced in accident claims involving product recalls.
