CRPS Caused By Slip and Fall Accidents

If you or a loved one has endured a diagnosis of CRPS or RSD resulting from a slip and fall accident, you may be eligible to sue the property owner and earn proper compensation for your damages. CRPS and RSD are neuro-inflammatory disorders that cause an immense and chronic pain that can be debilitating and cause a victim to endure not only physical pain but the pains of emotional stress and the financial burden of exuberant medical expenses. CRPS injury should not be suffered alone, and a lawsuit should not be filed without the proper assistance. Contact our top law offices at Normandie Law Firm today to learn how an experienced attorney with experience handling CRPS claims can help you sue the property manager responsible for your damages.

    What is CRPS?
Complex Regional Pain Syndrome, or CRPS for short, is a severe neuroinflammatory disorder usually triggered by an injury to the nervous system. The pain experienced by sufferers of a CRPS injury is often more severe than the pain of the initial injury. There is no cure for CRPS, and the only treatment is through regular medical visits, which can lead to significant financial stress. There are four main symptoms of CRPS, and can be recognized as follows:

    1. A constant or chronic burning pain that is significantly more severe than the pain experienced from the original injury. To another individual or caretaker, the afflicted area may feel cold, while to a victim the area may seem as though it is on fire. This area is also sometimes sensitive to touch, sound, temperature, and vibration.
    2. Inflammation of the affected area is also a common symptom of CRPS. This inflammation can cause bruising, mottling, red spotting, deformation of the skin (often resulting in the skin developing a ‘shiny’ texture), or discoloration of the affected area. The resulting inflammation can in some cases alter the skin temperature of the area which can cause excessive sweating.
    3. Spasms of the blood vessels and muscles are also likely to occur. In some cases, this can lead to spasms of the extremities as well.
    4. Insomnia or emotional stress can be a result of CRPS. The extreme stress the limbic system (the complex system of nerves located in the brain) experiences can create short-term memory issues, difficulties in concentrating, sleep disturbances, confusion, and many more mental stressors.

Other lesser symptoms of CRPS include:

    • Abnormal hair or nail growth
    • Unusual skin color changes
    • Pain from something that should not cause pain like the touch of clothing or a shower
    • Limited range of motion
    • Motor function disorders like paralysis or dystonia (abnormal contraction of muscles)
    • The fading and resurgence of symptoms

These are just some of the symptoms that victims of CRPS can experience. It should be noted that not every victim’s symptoms are the same and that every victim will experience these symptoms at a different rate. If CRPS is diagnosed early there is a chance for a better outcome of the disorder, however, diagnosing CRPS is challenging, and the time frame of said diagnosis can vary.

Causes of CRPS typically come in two forms.

    • Type 1: This is the most common form of CRPS. Often referred to as reflex sympathetic dystrophy syndrome, this variety occurs after an illness or injury that does not directly damages the nerves.
    • Type 2: Usually referred to as causalgia or Reflex Sympathetic Dystrophy is caused by an injury that directly damages a particular nerve.

CRPS and RSD injuries often arise after the victim suffers from some forceful trauma to an extremity. In this case, slip and fall accidents. If you have been diagnosed with CRPS because of a slip/trip and fall accident or because of a falling object, this article will be of particular use to you. An expert lawyer experienced in CRPS cases can help.

    Your Case
If you or a loved one has been diagnosed with CRPS or RSD because of a slip and fall, trip and fall, or falling object, then you may be able to sue the property manager, owner, or store for compensation for your damages. In the case of slip and fall injuries, the plaintiff must prove a premises liability claim against the defendant. Premises liability is a legal theory in which property owners are regarded as liable for accidents and injuries that occur on their property. These incidents can range from slip and fall on public sidewalks to having a box fall on you at a business.

Before premises liability can be proven, however, a plaintiff must demonstrate he is one of three forms of an entrant.

    • Invitee: someone who is invited onto the property, like a customer in a store. The invitation relies on the assumption that the property owner has taken steps to assure the safety of his place of business or property.
    • Licensee: A licensee is an individual who enters the property for his own purpose (like a social guest) and is there under the consent of the owner.
    • Trespasser: A trespasser is an individual who enters without the right to do so. If a plaintiff is determined to be a trespasser, then there is a high chance that legal grounding for your case can be lost.

The property owner is held up to particular duties just like a property entrant is. Property owners must ensure their properties or places of business exist up to a code of safety. This can include things like ensuring products are properly stocked or making sure that wet floor hazard signs are posted for customers after spills.

If you or a loved one fell at a place of business or property and was diagnosed with CRPS or RSD because of said accident, then it is important that you retain a qualified attorney with expertise in CRPS injury lawsuits. Victims of CRPS or RSD should not attempt to represent themselves in a possible lawsuit due to the complexities in filing said lawsuit. Our skilled attorneys at the top-rated Normandie Law Firm can walk you through the process of filing a slip and fall CRPS or RSD lawsuit.
