On April 8, 2020, Continuum issued a recall for their Lenox 2.5 Quart Tea Kettles. According to the recall, number 20-107, the recalled tea kettles can expel hot water during use; this poses a burn risk to consumers. Approximately 56,000 units have been affected by the recall.
The recall specifically includes the Continuum Lenox 2.5 Quart Whistling Stainless Steel Tea Kettle (with a three-layered bottom). The tea kettles were available in blue, silver, gold, and red. They have a stainless steel flat bottom (that measures about seven inches in diameter) and a bent edge extending about one inch beyond the kettle’s flat bottom. Lenox is written on the sides as well as the bottom of the kettle.
The defective tea kettle was sold at a number of stores nationwide, including Winners, Tuesday Morning, T.J. Maxx, Marshalls, Burlington, HomeGoods, and Home Sense. The defective tea kettles were available from September 2013 to November 2017 for approximately $30 to $50 each.
According to Continuum, there have been at least 14 reports of the tea kettles expelling hot water (through the top) during use; there have been at least 4 reports of burn injuries (some of them severe injuries).
The company is urging affected consumers to immediately stop using the recalled tea kettles and contact them for a full refund (given that proof of purchase is available). Consumers without proof of purchase will only be eligible to a partial refund (of $29.99).

The Danger of the Burn Risk
As explained above, the defective product can expel water while in use, posing a burn risk. A burn caused by hot water is often referred to as a scald. Scalds can result in red/peeling skin, blisters, swelling, and white/charred skin. Like all burns, the pain associated with the burn often does not reflect the severity of the burn. Depending on the severity of the burn, permanent scarring, tissue damage, and loss of mobility are possible. Without a doubt, mental and emotional suffering is also likely. Regardless of the harm suffered because of the defective product, affective consumers might have grounds to take legal action. Afterall, if the product had not been defective, the consumer would not have suffered any harm.
Understanding Product Liability and Your Right to Hold Companies Accountable
Do you have the right to sue if you were harmed by a defective product? Depending on the details surrounding the incident and the harm that you suffered, you might have grounds to sue – based on the concept of product liability. What is product liability, and how does it determine your right to sue after being harmed by a defective product?
Based on the concept of product liability, companies owe their consumers a duty of care. Companies have the duty to ensure that all their products are completely safe for consumers to use. This means that companies must inspect their products and subject their products to tests to be able to detect any defects present. This allows companies to identify and address potential hazards – before releasing defective products to the public. When companies fail to identify and address the defects present in their products, they are breaching their duty of care. Companies are also putting their consumers at risk of suffering harm. When the breached duty of care leads to an incident and to harm, the company could be liable based on the concept of product liability.
If you would like to learn more about product liability and your right to sue a company that negligently made a defective product available for purchase, do not hesitate to contact the experts at our firm at your earliest convenience. Our lawyers will provide you with all the information necessary to understand the concept of product liability and your right to sue.
You Can Sue and Recover Compensation
Upon reaching a successful claim outcome, you might have grounds to recover monetary compensation for the harm resulting from the defective product. Based on the details surrounding your product liability claim, you could be eligible to recover compensation for some of the following:
- Medical expenses
- Lost earnings
- Pain and suffering
- Loss of consortium
- Property damage
- Punitive damages
Could you be eligible to recover all the types of compensation listed above? The type and amount of compensation that you could be eligible to receive will always be based on the details surrounding your claim. If you would like to learn more about the specific type and amount of compensation that you could be entitled to receive, do not hesitate to contact the experts at our law firm at your earliest convenience. Our lawyers are ready to aggressively fight for your right to recover the compensation that you are owed.
How Can You Prepare to Pursue Your Claim?
Consumers are harmed by defective products often. Unfortunately, most of these consumers simply do not know how they should proceed after being harmed by a defective product; therefore, they simply do nothing and essentially forfeit their right to sue. All consumers should be familiar with the basic steps that they should follow after being harmed by defective products.
Consider the following recommendations that affected consumers should follow:
- Take photos of the harm caused by the defective product
- Take photos of the scene of the incident before cleaning anything up
- Take photos of the defective product
- Seek medical care for all injuries suffered
- Keep the defective in a safe place (do not tamper with it in any way)
- Contact the company to report the defect present in the product, the incident, and the harm suffered
- Do not agree to return the product, to a free repair, to a free replacement, or to a refund
- Gather all medical records associated with the harm caused by the defective product
- Gather any purchase records relevant to the defective product (including receipts, order confirmations, bank statements, etc.)
- Speak to witnesses present at the time of the incident and gather their contact information
- Gather any home surveillance footage that captured the incident (if available)
- Seek legal assistance a soon as possible
For more information about the steps listed above, do not hesitate to seek legal assistance with our experts at your earliest convenience.
How Long Do You Have to Sue?
Although you might have grounds to pursue a product liability claim based on the harm that you or a member of your family suffered, you must act promptly to avoid losing your right to sue. All claims are time sensitive. Specifically, all claims are subject to a statute of limitations which determines the length of time that claimants have to pursue their claims. If claimants do not file their claims within the time allowed by the statute of limitations, they will lose their right to sue.
How long do you have to file your product liability claim against Continuum? What deadline applies to your defective product claim? In California, product liability claims are normally subject to a two-year statute of limitations; this means that claimants only have two years to pursue their claims. As mentioned above, claimants will lose their right to sue if they fail to file their claims on time. However, it is important for claimants to understand that exception to the statute of limitations (which can toll or pause the deadline) could apply. To ensure that you have a thorough understanding of the time that you have to pursue your product liability claim against Continuum, do not hesitate to seek legal assistance with the experts at our firm as soon as possible.
