Car Strikes Pedestrians in Bloomington; Kills 3, Wounds 1

A tragic car crash in Bloomington claimed the lives of 3 siblings and put their mother in critical condition this past Sunday, June 24th.

The family was walking in their Bloomington neighborhood on Slover Ave around 8:30 p.m. when Leonardo Bravo, 19, lost control of his Dodge Challenger and crashed into the group. The siblings were pronounced dead at the scene.

Family and friends returned to a memorial site for the lost lives of the Jaureguis children: Andrea, 13; Jose, 17; and Angel, 20. The mother, 49 year old Marie, has not had her condition updated.

Investigators and police examined the scene; Bravo did not attempt to flee and remained behind. He was not arrested and police did not find any indication of drugs or alcohol contributing to the crash. The only explanation may be speeding and a dip in the road.

This dip has caused at least two drivers to lose control and crash into the fence of one resident. The female resident said that it is a very dangerous section of the road, as there are no signs warning of the dip and drivers can easily pass through without awareness, leading to accidents.

    Pedestrian Accidents

Often, pedestrian accidents happen at crosswalks when individuals are crossing the street and a car will turn into the path, ignoring the right of way law. In some cases, though, this does not happen, and a vehicle instead careens up a curb and strikes a pedestrian, as had happened to the siblings in Bloomington.

Many drivers are only aware of the other vehicles on the road and how to maneuver around cars, trucks, buses, and bikes. They may not see pedestrians until it is too late, or they may not give them the same level of respect. This can lead to accidents that are potentially even more serious than car crashes, as the injuries may prove fatal – there is no cushion or seatbelt if you are not in a car.

    Wrongful Death

It is important to note that if a family member or loved one passes away because of a car accident or pedestrian accident, there can be legal action taken against the responsible party. You could file a wrongful death lawsuit based on negligence and receive compensation for various damages.

In order to do so, you must prove four points of negligence: that there was a duty of care owed to the victim, and that duty was breached, which led to an accident that caused physical harm. An attorney can help you establish these four points.

If you have adequate evidence – photos of the scene, a report from the police and paramedics, eyewitness testimonies, and more – you stand a good chance of having your claim fulfilled or a verdict decided in your favor. You may be able to receive:

    • Loss of consortium
    • Loss of expected savings
    • Loss of inheritance and income
    • Pre-death medical bills
    • Pre-death pain and suffering
    • Funeral and burial costs

Crucially, you must file a wrongful death claim within two years of the incident or you will not be able to receive any compensation. This statute of limitations exists so that claims are handled as quickly as possible and do not take up excessive time and unnecessary space and energy.
