On Monday, March 6, 2023, a 22-year-old male, Patrick Nazarian of Glendale, entered the campus of Burbank High School and sexually assaulted multiple teen girls. New details point to the suspect allegedly being under the influence of laced marijuana oil at the time of the assaults.
According to the Burbank Police Department, the suspect entered campus at around 9 a.m. on Monday where he assaulted a 14-year-old girl in a school restroom (the suspect approached her in the restroom). Officers spoke to two other female students and determined that they were both inappropriately touched by the suspect; these students were 14 years old and 17 years old.
Nazarian has since pleaded not guilty to one felony count of sexual assault and two misdemeanor counts of annoyance of a child under 18.
It is important to note that Patrick Nazarian is a former student that graduated from the high school in 2018.
The day after the incident, the Burbank Unified School District board issued a statement. In summary, the board president stated that the district’s security protocols will be reviewed to ensure that the safety of students and staff is prioritized. Although this is a promising statement, the truth is that the statement comes too late for the victims that were already assaulted by Nazarian.
Schools and school districts, alike, have a duty to keep students safe. By failing to prevent the suspect from entering the premises, the school and school district could be liable for the harm that victims suffered. Child Sex Abuse at Schools
Schools are supposed to be safe places for students. In general, students trust the teachers, office workers, and other staff in their schools. Similarly, parents trust that their kids will be safe in school because these trusted adults should be doing everything necessary to keep students safe. Unfortunately, in many of these cases, it is actually staff that actually sexually abuses the child. Today, however, we will be discussing sex abuse at the hands of school trespassers.
Many schools have little to no security. Once anyone enters the premises, they can easily access children and harm them. Although the leading cause of harm to students in schools is definitely school shootings, harm due to child sex abuse in schools is also significant – and important to address. Child sexual assault is an umbrella term that includes any sort of sexual conduct with a minor, as a minor can never give consent to any sexual activity. Child sex assault includes rape, attempted rape, groping, touching, penetration of any type (with fingers or an object), masturbating in front of a minor, forcing the minor to masturbate, sending inappropriate pictures, etc.
The Consequences of Child Sex Abuse
Without a doubt, child sex abuse can have lasting consequences for victims. Child sex abuse can result in physical, mental, and emotional harm. This can include the following:
- Sexually transmitted infections
- Unwanted pregnancies
- Injuries to genitals
- Injuries to reproductive organs
- Lacerations, scrapes, and bruises
- Post-traumatic stress
- Anxiety
- Panic
- Depression
- Fear
- Increased risk of self-harm, including suicide
- Increased risk of drug use and drug addiction
Liability for Trespasser School Sexual Abuse – Can I Sue?
When someone trespasses onto school property and harms a student, the school and the district could be liable. Whether the trespassing results in sexual abuse or any other sort of harm, the fact is that the attacker should have never been able to get on the property. As briefly mentioned above, schools and school districts have a duty to keep their students safe from all hazards; this includes a duty to keep students safe from any trespasser.
Can they be liable for not having proper security and preventing the suspect from entering the school? Yes, the school/district can be liable – and can be sued. For more information about your right to sue Burbank High School and/or the Burbank Unified School District, contact the school sex abuse lawyers here at our law firm as soon as possible.
Can I Recover Compensation?
Yes – you could be eligible to recover compensation. In general, school child sex abuse cases are high-value cases. These cases can result in the recovery of some of the following types of compensation:
- Medical expenses
- Lost earnings
- Pain and suffering
- Punitive damages
- Treble damages
- Legal fees
Under California law, any sex abuse case that was part of a cover-up is eligible for treble damages – meaning that the final amount of compensation awarded can be tripled. In general, these cases can be worth $500,000 to $3 million, for instance. Our team is committed to getting our clients the settlements that they are owed within a reasonable length of time.
