A Recent Bed Rail Recall Brings Attention to a Common Issue

Compass Health Brands issued a recall for their bed rails. More specifically, they recalled their Carex Brand Adult Portable Bed Rails. The recall affected over 104,000 units of the product in the U.S. alone. The recall (number 22-040) states that users can suffer entrapment either between the mattress and the bed rail or within the bed rail; this creates a significant risk of entrapment-related injuries and death due to asphyxiation.

The recalled bed rails were sold online and in-store (at medical supply stores) from November 2012 to December 2021 for prices ranging from $22 to $80.

Compass Health is aware of at least three deaths related to their product – all of which were due to entrapment. All victims, all in their 80s, became entrapped between the recalled bed rail and the mattress because the bed rail had not been attached securely to the bed.

Adult bed rails are typically used for the elderly and for those who are medically frail, and sometimes for those who fit both of these categories. These individuals are already facing different medical struggles and other risks on a daily basis; there beds should be safe. These bed rails are supposed to be beneficial and prevent falls, for instance; they should not pose a direct threat to users.

If a loved one suffered harm associated with the defective Carex bed rails mentioned above, then you might have grounds to file a lawsuit against Compass Health Brands. For more information, contact us at your earliest convenience.

Another Example of a Defective Bed Causing Risk of Injury or Death

On September 29, 2022, Hillsdale Furniture issued a recall for their Flynn Twin Full Bunk Beds with Ladders. Based on the recall (number 22-778), the space between the second run of the ladder and the lower bed frame is wider than 3.5 inches and poses a risk of entrapment to children when the mattress is removed. The recall includes over 820 units of the bunk bed.

The twin full bunk beds are made of pine wood and are white and gray. They have a ladder that extends to the lower bed and to the floor. The model numbers included in the recall are listed below:

    • 2184-7080B
    • 2311-4080B
    • 2184-7080BASI
    • 2311-4080BASI

These twin full bunk beds were sold in-store at American Signature Inc. and Value City Furniture stores around the U.S. They were also sold online via www.valuecity.com. The bunk beds were available from May 2019 to April 2022 for about $1,200 per unit.

According to the recall, no incidents or injuries have been reported. The company is urging all affected consumers to block children’s access to the bunk beds and contact them for a free replacement ladder.

Unfortunately, it is very likely that there have been unreported incidents. Ultimately, entrapment associated with the defective bunk beds could lead to crushing injuries, suffocation, loss of consciousness, brain damage, and even death.

Without a doubt, defective beds like the ones discussed above could quickly become dangerous and lead to serious injuries and even death. Here at our law firm, we are ready to help you better understand your rights and help you sue the negligent manufacturer. If your child was harmed by this defective bunk bed, contact us today for more information about your right to sue.

Zinus SmartBase Euro Slats Metal Platform Bed Frames Recall

On February 23, 2023, Zinus issued a recall for their SmartBase Euro Slats Metal Platform Bed Frames. According to the recall, number 23-132, the bedframe assembly kit did not include reinforcing brackets for the corners of the frame; therefore, the bedframe could potentially collapse. This poses an injury risk to consumers. The recall includes over 30,000 units of the bed frame.

The recalled bedframes are black and are 14 inches high. They were sold in a variety of sizes, including twin, full, queen, and king. The following model codes are included in the recall:

    •  OLB-MESB-T
    • OLB-MESB-F
    • OLB-MESB-Q
    • OLB-MESB-K

The model codes can be found both on the product invoice and on the product box.

The company is urging all affected consumers to stop using the bedframes and contact them for a free repair kit with reinforcing brackets. This comes after the company received at least 14 reports of the bed frame collapsing, one of which included an injury.

The recalled beds were available online via Amazon, Wayfair, Target, Wal-Mart, Overstock, and The Home Depot from May 2022 to November 2022 for prices ranging from $74 to $200.

This is another example of a defective product that could potentially result in significant injuries. If you or a loved one was harmed in a bed collapse incident involving this Zinus bed, we recommend that you seek legal assistance as soon as possible to learn more about the legal options available to you.

    Who is Liable?

Who is at-fault for the harm that unsuspecting parties suffer because of bed collapse incidents? Liability for these incidents will be based on the details surrounding the incident. For example, if the bed was defective, the product manufacturer would be liable for any resulting harm. Likewise, if the furniture company that sold the bed knowingly sold a defective product, the furniture company could be liable for any resulting harm. Installation companies could also be liable; installation company liability would be based on the fact that their installation was faulty, for instance. Property owners, in general, could also be liable for failing to routinely inspect their beds and make repairs when necessary.

In general, liability is based on a duty of care that is owed to others – whether it is a duty to ensure that premises are safe for guests, products are safe for consumers, etc.
