American Honda Recalls Portable Generators due to Fire and Burn Risks

honda portable generator recall product liability lawyer defective compensation medical expense sue damages
On March 17, 2020, American Honda issued a recall for their portable generators – the recall affected the Honda EB2200i, EU2200i, EU2200i Companion, and EU2200i Camo portable chargers. According to the recall (number 20-090), the inverter assembly of the affected portable generators can short circuit with the presence of salt water, causing the unit to smoke or catch fire; this poses both a fire and burn risk to consumers.

The recall involves approximately 340,000 generators. As mentioned above, the recall involves four models of the portable chargers. The model names and serial number ranges are listed below:

    • EB2200i – EAJT 1000001to 1011342
    • EU2200i – EAMT 1000001 to 2098790
    • EU2200i Companion – EAMT 100001 to 2098790
    • EU2200i Camo – EAMT 1000001 to 2098790

The affected portable generators were available with either a red or a Camo cover. Both the name “HONDA” and the model name are printed on the control panel. Serial numbers are located on a lower corner of one of the side panels on the generators.

The affected portable generators were sold at Authorized Honda Power Equipment Dealers, The Home Depot, as well as other home improvement stores nationwide; the portable generators were also available online. The recalled generators were sold from February 2018 to January 2020 for prices ranging from $1,100 to $1,300.

According to the recall, Honda has received at least 13 reports of short circuits while the product is in use; this includes at least 10 reports of fire. However, Honda claims that no injuries or property damage have been reported.

Honda America recommends that all affected consumers immediately stop using the generators and contact their local authorized Honda Power equipment service dealer for a free repair. All known consumers are being contacted directly by the company.

Although the company claims that there have been no reports of injuries or property damage, it is very likely that there have been unreported incidents. Were you and your family affected by the defective portable generators recently recalled by American Honda? If so, you must seek legal assistance immediately instead of contacting a local service dealer for a free repair. Why do you need legal assistance after being harmed by a defective product?

You should seek legal assistance to explore the possibility of pursuing a product liability claim after you and your family were harmed by a defective product. Depending on the details surrounding your claim, you might have grounds to hold American Honda accountable for the damages resulting from their defective product. If you would like to learn more about your right to file a defective product lawsuit against American Honda, do not hesitate to seek legal assistance with the experts at Normandie Law Firm today.

The Dangers Associated with the Defective Generator
As explained above, the recalled portable generators’ inverter assembly can short circuit, causing the unit to smoke or catch fire. Without a doubt, this poses a significant risk to consumers. A fire could result in burn injuries ranging in degrees. The smoke resulting from a fire could also result in smoke-inhalation injuries. Suffering burns or smoke inhalation injuries could have further consequences, including but not limited to permanent scarring, loss of feeling/sensitivity, loss of mobility, post-traumatic stress, depression, and anxiety, for example. Property damage is also a possibility; the possible property damage includes both smoke/ash damage as well as burn damage. The extent of the property damage will depend on the details surrounding the incident; anything from home structures to family heirlooms with sentimental value can be lost.

    About Product Liability
Were you and your family affected by the defective portable generators recently recalled by American Honda? If so, you might have grounds to pursue a claim. You’re right to file a claim after being harmed by a defective product is based on the concept of product liability. What is product liability?

Based on product liability, all companies owe their consumers a duty of care. Companies have the duty to ensure that their products are safe for their consumers to use. They must thoroughly inspect and test their products prior to making them available for purchase. However, it is possible for companies to ignore or fail to identify/address the hazards present in their products, resulting in the release of unsafe products. When a defective product is released to consumers, companies are breaching their duty of care. This breach of duty could result in an incident which could directly contribute to the harm that consumers suffer.

Because of the concept of product liability, companies could be liable for the harm that consumers suffer given that the harm was directly associated with a product defect. If you would like to learn more about product liability and your right to pursue a claim, do not hesitate to contact our law firm today.

    What Should You Do?
No one ever expects to be harmed by a product; therefore, many people do not know how to respond after being harmed. When we purchase something, we purchase it under the assumption that it is safe for use, and we are stunned when we find that the product was never safe. It is normal to feel shocked and unsure of what to do next after being involved in any incident; however, all consumers should have at least a general idea of what they should do after being harmed by a defective product.

    Consider the following recommendations:

    • Immediately stop using the defective productfire-hazard-product-liability-lawyer-compensation-sue-attorney
    • Seek medical care as soon as possible
    • Take photos of all physical injuries
    • Take photos of the scene of the incident
    • Take photos of the defective product
    • Keep the defective product in a safe place, as is
    • Contact the company to report the incident and the product defect
    • Do not agree to a free repair, a refund, or a free replacement
    • Gather all medical records related to the harm suffered
    • Gather all documents related to the property damage suffered (evaluations, estimates, etc.)
    • Gather witness information
    • Gather proof of purchase (receipts, email confirmations, statements, etc.)
    • Seek legal assistance immediately

Why are the steps listed above important? When affected consumers follow the steps listed above, they are gathering the tools necessary to eventually pursue a product liability claim with the assistance of a product liability lawyer. Our product liability lawyers are ready to evaluate your product liability claim and provide you with the guidance that you need throughout the entire legal process.

    Recovering Compensation
Depending on the details surrounding your product liability claim, you might be eligible to recover monetary compensation for the damages that you and your family suffered. The type and amount of compensation that you are eligible to recover will always depend on the details surrounding your claim; because of that, it is always recommended for claimants to speak with an expert to learn more about the compensation that could be available for recovery.

Some of the types of compensation that could be available for recovery include the following:

    • Medical expenses: for all medical care associated with the harm that you suffered because of the defective product
    • Lost earnings: for the income that you lost as a result of the incident
    • Pain and suffering: for the mental and emotional distress resulting from the incident
    • Property damage: for the necessary expenses to cover any damage to property resulting from the incident.
    • Funeral/burial costs: for the expenses associated with death services (only awarded when the incident directly results in the death of a consumer)
    • Loss of consortium: for the lost ability to have a normal, family relationship with the victim
    • Punitive damages: awarded as punishment towards the company

    The Statute of Limitations
Although you could sue if you were harmed by a defective product, you must take legal action before you lose your right to sue. All personal injury claims, including product liability claims, are time sensitive. More specifically, claims are subject to a statute of limitations; a statute of limitations determines the exact length of time that claimants have to sue. If claimants fail to file their lawsuits within the time allowed by the applicable deadline, they will lose their right to sue and will not be able to take any legal action against the liable company.

What deadline applies to your claim? In California, personal injury claims are typically subject to a two-year statute of limitations, meaning that claimants only have two years to pursue their claims. However, it is important to know that exceptions to the deadline could apply (potentially tolling the statute of limitations). To ensure that you have a thorough understanding of the time that you have to sue, do not hesitate to seek legal assistance with the experts at our law firm at your earliest convenience.
