Dozens Injured & 8 Dead in New Mexico Bus Accident
A Greyhound bus that had nearly 50 passengers on board it suddenly blew a tire while it was traveling on Interstate 40 in Thoreau, New Mexico. The bus driver lost control and sped over the median into oncoming traffic, where it collided head-on with a semi-truck. The impact killed eight people. The accident occurred shortly after 1 p.m. on Thursday afternoon. It was disclosed that the bus was en route to Phoenix, Arizona.
Various debris, cargo, luggage, and materials from both the bus and truck littered the highway after the crash, making traffic slow down and causing emergency responders to have to navigate the crash to get close to victims.
Victims were transferred to a hospital nearby; the officials at the hospital said that 37 individuals were moved there and six more were expected to arrive. Highway patrol officials expect the death toll to rise in the aftermath of the incident.
Liability in Highway Accidents
If you were involved in a bus crash highway accident, you could take legal action against the responsible party. A Greyhound bus that suffered a blown tire could point to inadequate maintenance of the bus or improper manufacturing of the tires. You may be able to hold the company responsible for the accident. Greyhound has a duty of care to its customers and to everyone else on the road, and if you plan on filing a lawsuit, you must be able to show the four points of negligence.
First, there must be an established duty of care. As a paying customer, the driver must keep you safe and not drive recklessly. Other people on the road, too, must not be placed in harm’s way by the actions of the driver.
There must be a breach of that duty of care, whether by breaking the law, negligently driving, not paying attention, or using a bus that has not been inspected.
The breach must have caused an accident of some kind, whether a head-on collision, a sideswipe, or other kind of crash.
The accident must have resulted in physical injuries. If you were not injured, you won’t be able to file a personal injury claim.
Potential Injuries from Bus Accidents
The value of your lawsuit will be largely dependent on the injuries you suffered. If they were particularly severe or impactful and prevented you from living out your daily life or completing your job duties, you could receive a larger settlement than if you healed quickly and were not too badly hurt. Further, the insurance agent will consider your age, job type, and degree of fault when measuring your case worth.
Some of the injuries we have seen from bus accidents include:
- Neck and spinal cord damages
- Herniated discs
- Broken bones
- Sprains
- Fractures
- Severed limbs
- Crushing injuries
- Nerve damage
- Torn muscle

- Internal organ damage and hemorrhage
- Concussions and traumatic brain injuries
- Closed head injuries
