About the Folding Patio Chair Recall

Rite Aid Recalls Folding Patio Chairs - Defective Product Lawyers
Rite Aid issued a recall (number 19-193) on August 29, 2019 affecting about 18,000 folding patio chair units. According the recall, the metal frame of the folding patio chair can bend creating a fall risk for the individual sitting on the chair. The fall risk also poses a risk of injury.

Two types of the folding patio chairs are including in the recall. The affected chairs can be identified by the following information:

    • UPC 011822956628, item number 9043325-MMXIX in tan color
    • UPC 011822952361, item number 9044998-MMXIX in gray color

The defective folding patio chairs were sold during a short span of a few months between February 2019 and June 2019; the products were sold for approximately $30 each online and in-store at Rite Aid locations nationwide.

There have been at least four incident reports in which the chair’s frame suddenly bended. The few injuries reported include bruising and at least one instance of laceration.

The recall recommends that consumers who own the defective folding chairs stop using them and return them to the store in exchange for a full refund.

If you own at least one of the defective patio chairs sold by Rite Aid and you or your family were harmed in any way, it is essential that you do not follow the recommendation of the recall. Instead of returning the defective chair for a refund, you should seek legal assistance immediately to explore the possibility of pursuing a claim against Rite Aid for the harm that you and your family suffered. If you would like to learn more about pursuing legal action against Rite Aid, contact our firm today.

Fall and Injury Risks due to Defective Folding Patio Chairs

Falling off a chair does not seem like something that could cause significant harm; however, it is possible for the parties who fall from a defective chair to suffer at least some sort of injuries. Some examples of the harm that could be suffered include head injuries, fractures, sprains, strains, lacerations, and bruises, for instance. Although the average person might only suffer minor harm after falling off a chair, people that are already at-risk of harm (e.g. people with medical conditions that make fractures more likely) can be severely harmed by simply falling off a patio chair. If you or your family suffered any type of harm in direct association of a defective product, you could pursue a claim against the company that made the defective product available for purchase.

    What is Product Liability?

Product liability establishes that all companies have the duty to ensure that their products are completely safe to be used (as intended) by consumers. What does this duty of care mean? Since companies have a duty of care towards their consumers, they are responsible for testing their products, inspecting their products, identifying hazards, and addressing hazards all before making their products available for purchase. Companies must ensure that there aren’t any defects in the product’s design, labeling, or manufacturing, and that no harm could come from the proper use of their products. When companies make defective products available for consumers, they are breaching their duty of care and being negligent – this could make them liable for any and all harm that their consumers suffer as a direct result of their defective products.

Could I File a Product Liability Claim?

You could only file a product liability claim if you were directly harmed by a defective product. If the defect that caused your harm was associated with the product’s design, labeling, or manufacturing, you will have grounds to pursue a claim. Without a doubt, it can sometimes be difficult to understand whether you have the right to take legal action – especially considering how quick it is to place the blame on something that you could have done differently. However, as consumers, we generally trust that the products that we purchase are safe to be used. If you were harmed by a defective product, you should never blame yourself – the company is to blame for failing to ensure that the product was safe for consumers. You have the right to sue for the harm that you suffered.

Could I Recover Compensation if I was injured by a Defective Product?

If you were harmed by a defective product, you could be eligible to receive compensation. You could recover compensation for some of the following:

  • Medical costs
  • Lost income
  • Property damage
  • Loss of consortium
  • Punitive damages
  • The type (and amount) of compensation that you are eligible to receive will always depend on the specific details of your claim. To gain a thorough understanding of the compensation that you might be eligible to recover after being harmed by a defective product, such as the defective folding patio chairs sold by Rite Aid, do not hesitate to seek legal assistance immediately. Our lawyers will always fight for your right to recover the compensation that you deserve.

Product Liability and Statutes of Limitations

Although you have the right to file a product liability claim, you could lose your right to sue if you fail to take legal action within the appropriate length of time. Are all claims subject to deadlines? All claims, including product liability claims are subject to statutes of limitations – a statute of limitations determines the length of time that claimants have to file their lawsuits. If claimants do not file within the time established by the specific statute of limitations that applies to your claim, they will lose their right to sue.

What statute of limitations applies to your claim? In general, the deadline that applies to claims depends on the type of claim being pursued. In California, product liability claims are typically subject to a statute of limitations of two years; therefore, the parties affected by defective products will only have two years to pursue and file their claims. As mentioned above, failing to file within the statute of limitations can result in losing the right to sue. Although the statute of limitations establishes a strict deadline, exceptions could apply, resulting in a tolled statute, for instance. Because understanding the statute of limitations is such an important part of taking legal action for the harm that you suffered, you should always discuss the deadline that applies to your claim with an experienced attorney.

For more information regarding the statute of limitations that could apply to your claim, do not hesitate to seek legal assistance with the experts at Normandie Law Firm at your earliest convenience.
